 INFORMATION ON THE PROTECTION, PROCESSING AND SHARING OF PERSONAL DATA

            This note is communicated to members and candidate members in accordance with Law No. 6698 on the Protection of Personal Data (LPPD) to inform them about the activities of the WIM ASSOCIATION.

Law on Protection of Personal Data (LPPD) and Declaration of Consent

This notification is made in accordance with Article 10 of “Law No. 6698 on the Protection of Personal Data (LPPD)” that entered into force after being published in the Official Gazette No. 29677 of April 7, 2016

The LPPD specifies the obligations of individuals and legal entities that process personal data in order to protect the fundamental rights and freedom of individuals, including their right to privacy, which is protected also by the Constitution.

According to Article 10 of the Law, “when collecting the personal data”, it is obligatory to inform the data subject about “the identity of the data controller; the purposes for which the personal data will be processed; the persons to whom processed personal data may be transferred and the purposes thereof; the method and legal basis of collection of personal data; and the rights of the data subject” through “the authorized person”.

In accordance with Article 20 (3) of the Constitution and the relevant paragraphs of Articles 5, 6, 8 and 9 of LPPD, it is obligatory to obtain “the explicit consent of the data subject”, which is described as “freely given specific and informed consent” in Article 3 of the same law.

The ASSOCIATION for PROFESSIONAL DEVELOPMENT of MINING ENGINEERS (WIM ASSOCIATION) is a data controller under the provisions of Law No. 6698 on the Protection of Personal Data and other legislation. As the Data Controller, the WIM ASSOCIATION attaches importance to the security of personal data and acts in accordance with Law No. 6698 for the protection of any kind of personal data obtained, including that of its beneficiaries, those participating in its activities or its personnel, obtained as a result of the activities of the WIM ASSOCIATION.

Method of Collection of Personal Data

The personal data collected, stored and shared, and transferred with the consent of the member, is obtained through applications of members and member candidates to our Association. They fill in the information, including name and surname, identity number, address and details of curriculum vitae, requested in the application forms, and send their requests to WIM ASSOCIATION either through electronic means or as an original copy, with the relevant documents attached. Files containing personal information are kept either in folders in the archive of the WIM ASSOCIATION, which is always kept under lock and key, in the case of original paper copies, or in an electronic medium or on a computer, for which all kinds of security measures are taken.

            When the website of the WIM ASSOCIATION becomes fully operational, members will upload their CVs and information and certificates related to their professional development to the database by entering their own passwords and send the original paper copies to the WIM ASSOCIATION to be included in the member files.

Purposes and Legal Basis for Processing Personal Data

  • • The personal data obtained by the WIM ASSOCIATION consists of the personal information declared and documented by members and member candidates and included in their detailed CVs and other documents related to their professional development.
  • Applicants seeking membership of the WIM ASSOCIATION must meet the requirements specified in its by-laws. Accordingly, members must submit their personal information, the level of their professional development and detailed CVs to the WIM ASSOCIATION to prove that they meet such requirements.
  • Members of the WIM ASSOCIATION and candidates for membership must prove that they are mining engineers.
  • Applicants whose professional development is deemed appropriate by the respective commissions of the WIM ASSOCIATION are encouraged to become a member of WIM ASSOCIATION and are offered to UMREK to become a Competent Person.

Terms of Transfer of Personal Data

  • Files containing the personal information of a member candidate and other details from his/her CV are shared with members of the Board of Directors for the evaluation of the request for membership,
  • Whereas the addresses and contact information of members and member candidates are shared with the postal or courier company when a delivery is to be made to them.
  • The address and contact information of members and member candidates are shared with NGOs or other institutions with which the WIM ASSOCIATION jointly organizes training or any other event, and for the making of announcements to ensure the participation of members.

Rights of the Members of WIM ASSOCIATION under the LPPD

If a member does not want to receive mail, faxes or e-mails sent by the WIM ASSOCIATION, she can send a request via e-mail to info@mskderneği.org.tr. She may also request any personal information retained in the records to be deleted or destroyed. The processed personal data will be destroyed immediately upon the receipt of such a notification.

Members of the WIM ASSOCIATION can apply to the association to exercise their right:

  1. to know whether his/her personal data has been processed;
  2. to request information if his/her personal data has been processed;
  3. to know the purpose of processing of his/her personal data and whether such data have been used in accordance with that purpose;
  4. to learn the third parties to whom his/her personal data have been transferred, domestically or abroad,
  5. to request rectification in case his/her personal data have been processed incompletely or inaccurately;
  6. to request the deletion, destruction or anonymization of his/her personal data, provided that the conditions based on which his/her personal data was processed are no longer valid;
  7. to request the notification of transactions made pursuant to points 5 and 6 to any third parties to whom personal data has been transferred;
  8. to object to the occurrence of any impact against himself/herself through an analysis of the processed data exclusively through automated systems;
  9. to demand compensation for damages and losses suffered due to the unlawful processing of personal data.

            Members who want to exercise their above-mentioned rights can fill out the form that can be accessed on www.mskdernegi.org.tr and send their demand to “ ” along with a signed copy of the form, the necessary information to verify his/her identity, an explanation of their request to exercise their rights specified in Article 11 of the Law on the Protection of Personal Data, and the necessary documents identifying their identity, either personally or through a notary public notification, or other methods specified in the LPPD, or via e-mail to info@mskdernegi.org.tr, signed with a secure electronic signature.
